Well... The car originally had a 3T40 automatic... However, it was replaced with a reman unit last spring. It should be a 3T40, but I think it might be a 4 speed. Why? Because at speeds above 40MPH if I press the gas down to accelerate, it will try for a second, and if I push it further it will *Downshift*. It does this on the highway and on local roads. It almost feels to me like it is downshifting from OD. Is it possible they replaced it with a 4T40, and is there any way to tell for sure? I have no tach.

Impossible. 3T40 runs off vacuum. 4T40E is electric.
The torque converter slips after 3rd to give you lower rpm. When you get back on the throttle it rises to what the rpm should be for 3rd gear.
Ah, that makes sense. I also just remembered I replaced the transmission fluid and filter a month and a half ago, and the filter kit was for the 3T40.... Damn and here I was getting my hopes up. Ah well.
It's the torque converter unlocking. Personally I wished the speed was a more like 50 before the converter locks as 40mph in a LN2/3T40 car with the converter locked is anemic in town.
