got a ticket....need help
Wednesday, February 15, 2006 4:04 PM
So on top of my coolant leak, my day just keeps getting worse. Here's my problem. I was heading east on eglington, and i'm waiting at a red light, 1 stop before birchmount. The eastbound light was red, the northbound just turned red, I started creeping forward in anticipation of my light turning green. There was a cop behind me, the light turns green and I get going, 10 seconds later he pulls me over. He explained that even though the light was green, I crept past the white lines ( where people cross the street between ), I had no attitude, was polite and everything, hoping to get a warning. He comes back to me after doing his thing in the cruiser and gives me a $190 ticket for running a red light. Has anyone ever had this happen to them, is so what did you do. If I pay the ticket do any points come off my record, does insurance increase etc. etc. etc., and if so should I fight the ticket? I would prefer to pay the ticket and have no issues on my record, but I would like to know what this would do to my record and should I fight it? Any help on this topic is highly appreciated. Thanks in advance.

That sux...
I have been pulled over out of nowhere over a loud exhaust, and it's just their way of screwing with you...

A ticket for running a red light will be demerit points, and more than likely your insurance will go up.

Your best bet will be to call up one of those xcopper places, I have used Ontario traffic tickes before, and had the case thowen out of cout.

the bad thing about the ticket
3 to 4 demerit points, cant remeber. its a bs charge so I would fight it personally because insurance is gonna sky rocket. thats a serious offence according to insurance. was it a young cop on a power trip? gotta watch out sometimes.

did u not see the cop behind you? call pointts or someone like that. it'll cost ya about 6-700 but points will probably be salvaged. or take it to court yourself and say you were just learing to drive stick and slipped it accidentally.

Yes, you should fight it.

Points mean nothing when it comes to insurance - they only care about convictions. Thats means you have to beat the ticket for insurance not to find out... paying, pleading guilty, or losing in court means insurance will know.

He most liekly targeted you for your loud music, sport compact etcv.

Why would you creep over the white line???
Thats what you do in anticipation of a race. Was it a few inches or a few feet?? Obviously you saw the cop, what were you thinking?? What was the point of anticipating the light??

Honestly the more I read these 'Bullsh-t' tickets, the more I realize they are usually deserving 9/10 times. No offence to you and I'm no angel, but I've never gotten a ticket I did not deserve.

If I was a cop and saw a young kid in a modded car infront of me rolling through the white line for no apparent reason....I'm gonna pull you over.
The white line is there for a big reason, Peds don't really like to rolled over. And lots of idiot pedestrians like to run across at the last minute.
Chalk it up to experience to be on your BEST behavior around cops, and for gods sake look around you at a light, you never know who's behind you.

Agreed...No one can say cops are fair...far from it.
Sometimes the Stereotype of being a 'racer' is something owners of modded cars have to deal with when they mod cars. Fair or otherwise.

To answer your original Q:
If this is your first ticket, then when you take the ticket in to request court, or just pay; Request a 'First Apprearance' This is a plea bargain with the prosecuter, most likely he will significantly reduce it, but never drop it.
If the end result is not to your liking, request a court date and hope the officer does not attend, thus dropping your charge.

To answer some of your guys questions, 1) I did not see the cop he wasn't behind me he was in the middle lane 6 cars behind me, I was in the far left lane 2) The car beside me did the same thing as me, 3) I don't know what I was thinking, 4) I'm not saying that I'm completely innocent in this situation, just that I would categorize this as something that could have gone either way, mabey he was trying to prove something to his partner or himself, mabey he pulled me over b/c of my loud exhaust, lowered suspension and tinted windows.

Whatever the reason for giving me the ticket I got it. The last time I got a ticket was 7 years ago for speeding I was doing 80 in a 70. I have no issue with paying the fine just don't want it to affect my insurance. When they give out tickets are they supposed to tell you if it means loosing points as well? On the ticket the exact wording for the infraction is "Proceed before green" not that I ran a red light. I think that I have an arguementable case. Like I said I would prefer to pay the fine and not have this affect my insurance or record.

Thanks for the help with those links, I am going to call Pointts since they are down the street from where I work.

Like I said I would prefer to pay the fine and not have this affect my insurance or record.

No.

It doesnt work that way.

Paying the fine means you are found GUILTY.... you are admitting your guilt and are convicted. Insurance will find out.

The ONLY way for this NOT to affect your insurance is by fighting it in court and winning... no plea bargains, no reduction of points or fine... you have to win full out.

Don't call points.....don't waste the effort or the $$.
Their definition of a 'win' (thus costing you hundreds of dollars) is$1 off the fine or 1 point. Both of which are considered a 'guilty' by insurance.

Do as I mentioned and do a first appearance, state your excuse, and what you want off/why. If this is not to your liking, go to court. The worst that can happen is you get nailed for what you already face.
Best case the cop never shows, ticket dropped. (this happens more often than you think)
Points and xcoppers get paid to do what I'm telling you right now. They are neither lawyers, nor have an 'in' with the prosecution.

i kind of understand the ticket now, as if both of you crept forward, in all likely hood it would have looked like a race. although, if he was 6 vehicles behind, who's to say you crept forward from that point of view? granted, he'd see you move, but who says you were flush with the line to start?

under what sec of the HTA were you charged with it will be a number close to the bottom of the ticket for example sec 128 is speeding. tell me what section it is and i will tell you what the exact wording is in the ontario provincal Statutes book this will help you fight your case no matter what you plead in court . if you deside to go to court you will be given 3 options Guilty, not guilty, or guilty with an explanation, personaly i would go with guilty with an explanation it will be the easy to do your self. you will still get the charge on you record but the fine will probable be lowered or if your really lucky they wont add any points to your license. These are just my Opinions from what I see in law classes every day in no way is this advise in any way just my own personal opinion and am not Responsible for any form of outcome Regarding this or any other issue that may Arise.
