He's too hung up on legal terminology. He was an attorney after all, they tend to do that.
The reporter picked up on this, probably knows about it from previous interviews and he decided to pick the the scab and try to prove some point.
Reid truly didn't misspeak too badly, but he could have done better no doubt.
