I believe they can, though I'm not sure which law specifically applies. It might even have something to do with emissions.
You can legally have it in the car, but it has to be disconnected and not accessible to the driver.
So basically, if the hose is disconnected and loose in the trunk, you should be fine but if you've got a remote bottle opener or something that enables you to hook it up from the driver's seat then you're SOL.
r u serious..
i am trading a hood for a nitrous system on saturday.. should i still do it.. i dont want to get in trouble again with the law hehe

Just don't hook it up on the street.
There's no use for nitrous on the street anyway.
Nitrous Oxide (NOS) - Are ILLEGAL to have in your car as stated under the Transportation of Dangerous Goods Act unless the container and vehicle is
clearly marked to have such goods and is equipped to carry such goods.
Meaning not only does the Bottle have to be disconnected while driving on public streets, but you also have to advertise the fact that you are carrying Nitrous Oxide. Cops will just love that.
If insurance finds out you are, have, or will be running Nitrous on your car then consider your policy cancelled. Track or otherwise, they do not care.

There was a link of usefull information in another post.
It says "Nitrous Oxide (NOS) - Are ILLEGAL to have in your car as stated under the Transportation of Dangerous Goods Act unless the container and vehicle is clearly marked to have such goods and is equipped to carry such goods."

So you may want to look into the act to see what you need to be "Legal"
wait though, somebody a while back said that carrying a nitrous bottle is the exact same thing as carrying a propane tank to canadian tire for a refill, both are compressed gasses being transported in your trunk, and last time i checked, it's legal to refill your propane tank at crappy tire????
I think that as long as your bottle is not connected and connection is not accessible to the driver, its ok.

The insurance issue is probably 100% dead-on. I'll bet they drop you in a heartbeat if they get wind of it, regardless of whether it's hooked up.

Even so,
If they are analogous, a vehicle equiped with propane tank(s) must have that clearly marked on the vehicle. Thats why you see 'Propane Equiped' on Taxi's and trucks.
I've also seen it happen. First hand experience as well as the HTA and Transportation of Dangerous Goods Act to back me up.
'looks like we found Nitrous'
'Oh, no, look... its not connected...'
'Ya, we're gonna have to call in MTO...'
'sh1t.'

I imagine that if they wanted to burn you for it, they could, and that they simply turn a blind eye to bbq propane tanks since they're not really what the law was intended to control.
i have heard that too... you CAN have the tank as long as they know... for their safety... if your in an accident, and your car is up in flames... they all need to know u have highly flammable compressed gas in the car... as in taxi's and delivery trucks..
and as for the propane, you are allowed to transport a tank of propane from crappy tire to your place when refilling it... if u get pulled over, im sure you will say "im just on my way home" cause who would want a propane BBQ tank in their trunk
but if you planned to keep it in your car for good... you would have a problem.. the fact is, they know nitrous is not for home use to fill balloons
***Thanks again to stargrrrl***
ur allowed to have the bottle but has to be shut off....... as for the advertising .. u can put a sticker anywhere u want in the car..... my friend has the bottle with the electronic switch in the glove box so its always ready with just a flip of the switch =) but he has a TINY little sticker advertising NOS by his handbrake ..... cops pulled him over many times n he shows the tiny sticker n dosent get bothered at all !!!
This question was actually addressed by our local police force at a "take it to the track" event last year;
According to the officer, it is legal to have it in your car (off, and unaccessible), because the amount contained in an average bottle of nitrous, is below the level at which you have to advertise you are carrying around hazardous/explosive materials, and as such, no sticker or other is needed.
He also used the analogy of a box of hairspray containers, or a propane tank for camping, etc. It was not so much the purpose of transporting it, moreover the amount that is contained within the vehicle.

I actually had an empty bbq propane tank in the car when I had my last accident this past September.
Completely irrelevant... just thought I'd throw in the factoid.
propane tank for camping just so u know how much damage those little green bottles can do ..... if that little camping tank blows up .... u can destory the WHOLE camp site !! not just ur little site =P
Correct me if I am wrong... I heard that Nitrous was illegal in Ontario because it is considered as a "controlled substance".
I guess I can answer that well being a police officer myself. Carrying any compressed compustable gas, chemicles etc is ILLEGAL in the province of ontario wheither it is open or closed. Most would not know this but it is even illegal to carry a full bbq propane tank in your car. The only exception to this is if you take a 1 day course that allows you to transport compustable compreesed materials. This is a course designed for Truck drivers etc but is open to everyone. With this you will recieve a little car or certificate stating your permitted to cary the material in your automobile. But i'm not sure about the insurance aspect of this.
