Anyone appealed a speeding conviction?

Just wondering if anyone knows the process and can help out. Reading this, it seems like I need a whole bunch of forms and transcripts and stuff and have only 15 days to get them!

If its anything like appealing a stop sign ticket, you have to go to the address on the back of the ticket and book a court date within 15 days. If you dont go within that time then you are unable to and you have to pay the fine and accept the concequinces. The court date will be far away though. I booked mine in August and my date is in May.

I'm not looking for a court date. I had mine this morning. I'm looking for the forms and procedure to appeal the decision.

okay weasel.... I got this guy..... he makes tickets disappear.....
LITERALLY.....

I had 6 points.... careless driving...
he calls me up like a month later.... says .... it disappeared..... to this day my drivers abstract says NOTHING ..........

im not 100% sure on how to appeal it, but if you go to where you filled out your form for your court date, just ask them for an appeal form and explain your situation.

Hello,

Ok, if your gonna appeal, you need to have a good reason to, why dont you explain the situation that happened, ie were you caught by an officer who had a radar gun pointing towards your car. Or were you pulled over by a cruiser. Im currently studying our judicial system and I know with that if you are going to appeal any case; it has to do with something other than what you were convicted for. For example, contempt of court, biased judged. Try hard, and what helps is if you speak to the crown before you go into court and discuss what your planning on doing. Good luck, make sure you tell me exactly what happened, Ill get back on here and tell you what I would do in your position.

I do apologize i dont think i anwsered your question properly. Just remember, as long as it was not a drinking and driving offence than its not criminal. All that transcript stuff is for criminal offences and your offence is speeding. Before you plan on appealing that, you will need to pay the fine; if you cant pay the fine you can request to stay the charges (which basically gives you more time) and lets your appeal process began. Now remember with any appeal your moving up the scale in terms of the type of court. So you will not be appealing to a justice of peace (people think those guys are actual judges but their not), you will be appealing to a real judge. You have 15 days from when your court ended to do this. You have a chance, but remember, tell me what happened and will try and think of a good reason to appeal.

I'm not familiar with appeals procedure in Provincial offences but I can offer some tips that could be relevant to your case. PM me if you would like some info.

What happened is apparently I went past a cop who was parked on the side of the Gardener with a radar gun doing 126 km/h.

According to him, he then started chasing me within 1 second, caught up to me in 10 seconds, and then for some reason didn't pull me over for 2 and a half km on the ramp to the DVP.

He did all this while never taking his eyes off my car.

The first I knew anything about there being a cop on the road was when I pulled out from in front of a van who was overtaking me. Then I saw a cop coming up from behind. I moved over so he could pass and he didn't so I moved back in. Then he pulled me over.

So basically, he openly lied in court so he could get his ticket through.

PERJURY...get em for it. Took you a while to respond, I didnt think you cared about it anymore. But I hope you filed for an appeal, this is gonna be a tough one, but if your gonna get him for lying, make sure you speak to the crown before anything. This guy could get suspended for that if convicted, at least thats what I think. keep us posted, did you check to see if he had a radar slip?

I don't think he even remembered the car. The only distinguishing feature he could mention was the "black spot where the license place should be" so he could nail me with the ticket for the smoked cover.

I haven't filed an appeal. That's what this post was about. I have no idea how to do that. And now I only have a couple days left.

dude reallyt is simple just go to the court, all the forms are there you fill them out there to get the apeal there is two possiblities, they say yes ok we will get something in the mail, or you se a justice of the peace which again you would have to go to the court house to do i would just go to the court house any ways to see the jp to see what hapens they are very resonable people just be polite but not fake

They don't need to show you the radar slip anymore, it's their word against yours.....who do you think they'll believe.

Speeding tickets (where radar is involved) are the hardest charge to win becasue they have facutal proof you were speeding. In all honesty, appealling is a waste of time....you can't dissprove a radar or a cop who is sworn under oath to tell the truth and nothing but the truth.

Kevin, this is what you should've done before the court::

On the day of your court get someelse to attend. Then, have this person let the court know that you were sick and that's why you didn't attend. They will set another date which will agiate the cop and lower the chances of him showing up for the next date. Keep repeating this method till he doesn't show up.

If you choose to appeal just head down to the courts and offences office which is in Downtown Toronto and fill out an appeals form.

i just got a speeding ticket and i'm appealing it........
i haven't received the court date yet but i was thinking about asking for my disclaimer.....

i was doing 143 in a 100.......427 north......
i have asked for the disclaimer b4 and i'm sitting on my new court date......still waiting for that one....but would the whole disclaimer thing work just as well as someone else showing up......
and yes obviously you can only do that once....
