Newbie Ticket, 16yr old vs courts LONG

If this in the wrong forum move it, anways I just had a good time bowling with my girl and a few other friends, around 11:30ish we left, I was by myself and my friend also drove, we live across the street, its about a 15 min drive from the bowling alley. We talked bout who knew the quickest way and of course we disagreed on it so we jsut had to race home. He took off outta the parking lot, I backed out and came up to the parking lot exit, now I believe that the cop was behind me in the parking lot, because he told me that I did not come to a complete stop at the exit, what I remember is not hitting my brakes but coasting up to and allowing it to just began to roll back to a stop, a usual thing i do with any incline, then i took off to catch up to my friend, at this time it was probably 11:42-45, its a 55 mph area, i was crusing at 75 to catch up to him, I caught him and passed him, its a 3 lane road w/ a center turn lane which i used to pass him. Keep in mind I have no clue the cop is following me at this time, I get in front of him and slow down to 65 or so and probably 3 car lengths in front of him, then i notice a car coming up fast in the center turn lane he cuts infront of my friend to get behind me with probably less than .5 car length between him me and my friend. This is when it finally dawns on me how retarded I just was. He tuns his lights on and pulls me over.
He comes up to my window very pissed off, as he should be, and I tell him how retarded i was and some other stuff, at this time he tells me some interesting stuff. He has a video that captured it all. I admitted to going 85, I was very very nerious and was bout to s*** my pants at this time and I was afriad that if i said a speed to low he was really gonna get pissed. Anyways i tell him that and he gives me 2 options, take a speeding ticket, 2points or a reckless driving ticket 6 points. Obviously I take the speeding ticket, he goes back to his car, a minute or so later he comes back and asked me if I work at the bowling alley, i replied no and told him i work at a hospital. He says you know with your restricted license you cannot drive between 12-5am, i sighed thinking it was way passed midnight. He tells me he can arrest me and other really cool stuff bout driving this late and goes back to his car. I turn the key over so the radio comes on, reads 12:03, figures. Ticket says 12:01 He comes back and gives me the ticket, and im off with 2 tickets.
1st: Misdemeanor 'Violation of Restriced License'
2nd: Civil Infraction 'Basic Speed '

I have to apear in court because Im 16, which isnt going to be much fun. The officer threatened to show the video and most likey he said the judge would consider it reckless driving.
Under the remarks it says: Admitted to driving 85/55 w/b passing another vechile using turn lane. Left Royal Scott(bowling alley) parking lot without stopping before entering road.

I just need some advice for when i go to court. Anyone have an Idea of what type of fines Ill be facing? I probably could get the violation of restricted license thrown out but can i do that without challenging the C/I ? Thanks excuse the grammar and spelling!

report the cop for speeding without his emergency lights. but that's about it.

plead guilty and pay the fines. you know you were wrong, so there's no way of you to challenge it.

Would that make a difference if he didnt have his lights on, I mean he was flying to catch up to me

Holy christ you live right by where I grew up.
Anyway, how much over the speed limit is the ticket for? Did he drop it down to 5 over like most the local cops or did he leave it at your actual speed (20+ mph over) . Those notes he wrote down are just for him to remeber all the @!#$ you did wrong if you decide to fight it.

Why do you have to go to court? I got tickets from LAPD and eaton county cops when I was 16 and I just had to call down to see how much the fine was (5 over) and mail it in. It was about 80-90 bucks i believe.

whoa...thats crazy. I got a speeding ticket for 85 in a 65.. paid $100 flat BUT my license is suspended..or i could had paid $200+..o well a month of suspension isnt so bad

under the description it only says 'basic speed' no actual speed is listed. I said that i thought i was going 85 and thats in the remarks part of the ticket. I have to go to court because me driving after midnight is consider a misdemenor and when your under 17 you have to appear in court. Whats even more gay my b-day is less than a month away...

u may be able to get away with the driving after 12 since the officer is the reason for you not making it home on time.
cuz according to your story if he hadnt pulled u over you would have been home with 15 minutes to spare.
as for speeding i think your gonna just have to take the ticket .

I dont exactly get the 'basic speed' can any one go into detail bout that or will it beconsidered 85/55? Also can i fight the violation of the license and not do anything w/ the reckless?

Well basic speed could be a standard set for the entire county depending on what kind of street you were on. Here its as follows Residential-25, 2 lane Highway-45, 4 lane highway-55. Hey I got court on April 5th for "reckless driving" we were actually street racing but the officer defines street racing as 'having a set distance point a to point b trying to get to b in the lowest possible time' but the only reason I have to go to court is cause the other guy cant drive and he wrecked. Totaled his car IDK how but he got sideways 3 feet in front of me when we were doing bout 85 then he hit a pole. What you should do is call your states attorney office and possibly work out a plea bargain. I will have to pay half the pole on be on probation for six months. Dont know why im telling this but it seems the perfect time for drivers under 18 to fess up Any ways I hope this helps.

I'd take it "basic speed" as just their normal 1-10mph over infraction. I mean, I thought I got just about every local ticket possible but i've never heard of that one.

Cops hang out in the royal scot parking lot all the time radaring grand river. So he probaly was behind you the whole time. Its probaly not the speeding that pisted him off but the fact that you passed somebody (he doesn't know it was your friend) in the freiking turn lane going 85.

I would just call down to the court to make sure you have to show up as sometimes the cop doesn't always say the right instructions on the roadside. Was it an eaton county cop? know his name by chance?

It was Clinton County cop, so i get a nice ride to St Johns, I cant really read his name but i think his last name is Castdow or Castdan. I hope to god its just a 1-10 infraction.

well man just play your cards in court and hope that the judge got laid the night b4 and has his morning cup of vodka. I got a ticket for tailgating an ambulance at 82 mph

It was a 6 point ticket Ive taken defencive driving,

driving is like nascar, stop lights are the cation flags, cops are the pace cars, ect ect

If you want to get out of it try this. Use your 7th amendment. Ask for a jury, because you'll probably have a better chance of getting off since most likely a lot of them have been in a situation similar to yours.

its a speeding ticket, not a felony crime. why waste all that time over. well not to be a dick but you shouldnt of been driving like an @!#$ in the first place. passing in the turning lane and doing 30mph over the speed limit. just go to court and try to talk your way out of it. if he uses the video, i dont know how your going to make a story to go along with it. its a learning experience. it sucks but, just pay it and move on.

Exactly.. you're juust going to have to pay the consequences. Did the exit have a stop sign by the way?

Alright I need to clear somethings up, one I ADMITTED to doing 85/55 because i had no clue how fast i was really going, i could of been doing 70, i said 85 because if i was doing 85 and said 70 he woulda been pissed. Im not going to worry bout that part of the ticket, that is probably right around $100, basic speed = 10 over. I had a friend ask his father who is a well know laywer around here (Abood Law), I was told the Violation of License carrys a fine, now my friend told me this part and he blows things outta proportion. Anyone know bout violation of restricted license and what fines go with it??

im not following that last post. so you wanna know whats the fine for driving past 12 since your not allowed, right? if so, i cant see it being a big fine. i cant even see it being a fine at all. maybe a warning at first, but you did get in trouble for all the other stuff so that can come into play. if your buddys dad is a well known lawyer, just ask him, he should know.

I just need to talk to my friends dad and not my friend he seems to lie bout stuff like this. I hope there is no fine, its so ghey u have to go to court about it! I mean come on its spring break... gimme a break

yeah man good luck , I live in canada so I dont know how it is In the states but I had the same problem, took it to court and everything, the cop didnt show so i got off scott free!

My sister got caught driving past midnight when she was only 16. She initially got pulled over for "changing lanes without signaling", pretty dumb...anyway, she got a $100 fine for being out past midnight and with more than one passenger in the car, but no points off the license.

I just called, she couldnt tell me anything but the violation was $95 and I have to go to court. WTF she couldnt tell me anything else? I couldnt even find out the cost of the basic speed and pay that. She did say both tickets would be considered one, which i think is going to turn out really really bad

You won't get in much trouble. Wtf do you think they're going to do? Lock you up for being out at 12:01? Come on... Don't sweat the small stuff man... you might have to pay a couple hundred dollars in fines, MAYBE some some community service if the judge is a dick, and MAYBE lose your license for like 30 days. In the end, the misdemeanor will get dropped so don't worry about it.

$200 isnt anything small to me, considering I make 6.35 part time... Losing my license, I co-op for 2 credits right now, if i cannot co-op I lose 2 credits, which means I have to make it up, $200 a credit. Not so small now.....
Yes maybe I'm thinking harsh but so far I only heard horror stories bout this county court, and more about my friends screwing up.

man you should consider yourself lucky if it's only 100 bucks. I got pulled over once for doing 57 on a 35 mph zone, my ticket was 240 bucks. I just paid it and didnt make a big deal out of it. oh and I only make 5.15 per hour, so you should be fine, your not going to die.

Whatever you do, DO NOT use the defense, "I wouldn't have been out past midnight if the cop hadn't pulled me over." That will only get you in a lot more trouble. If you hadn't been driving like an @ss, he wouldn't have had a reason to pull you over. So, DO NOT use that defense. I recommend just pleading guilty, apologizing and hope they go easy on you. First offense, they usually will. Just a little advice from a cop.
