Legal Help Needed

Hey Guys, O.K. Some of you may know - I had my engine replaced this summer due to a cracked rod with a vehicle that had intake and a header. Somehow the dealership said "Oil wasnt getting to cylinder 4 because of your modifications" I presumed to tell them oil is internal - and intake and a header are external mods how are they related. Well they didnt know. The car had 42,088 miles on it with the warranty ending at 36,000 miles, Is there anything I can do about this? I Still have all the paperwork and GM "Promised" they'd get back to me on why the engines rod cracked. Anything I can do with a Lawyer or attorney?

no it was past warranty. check your total warranty book thing and owners manual a lot of stuff is covered longer then the basic warranty

if you were maybe at 36200 i can see....but at 42000 why would you even assume its under warrenty? They dont need to cover it and id be surprised if they inspected it for free, usually its a flat shop fee of 50-100/hr

Update your registry so we even have an idea of what sort of car you've got.

Isn't the powertrain warranty on new cars 5 years? I know it was introduced in 2001 but don't know if it was pulled back again in later years.

There is a bit of legal action, its called the moss/ magnuson act.

Granted it has alot to do if you have a warrenty, But it has a few subsections About shops refusing to work of modified cars.

The Magnuson/Moss act is all about warranty, isn't it?

He's already stated that his car is clearly out of warranty.

I know the 03 and 04 cavy sold in quebec had the 100 000km warranty on the powertrain and I remember Gm advertising them Us J with the same warranty.

The engine and transmission have a longer warranty.

5years or 100 000km(or 60 000miles)

Shoulda went for the 100,000 mile powertrain warranty... little extra dough, but woulda been worth it in your case.

Not necessarily. The M/M act doesn't apply to aftermarket warranties, I don't think. You'd have a much tougher fight on your hands trying to get aftermarket warranty coverage on a modified vehicle, whether or not the mods have anything to do with the problem.

Unfortunatly out of warrenty they don't need to help you at all. Sorry but I think your out of luck.

yeah... i had that problem in a way too... my engine blew at 109000 km luckily i had the extended factory warranty, so it cost me $100 to get my engine rebuilt. it went 2 months later cuz they forgot to clean the oil pan, and it cycled the metal fragments back through and it blew again. again, 3 months later, this time at 137000 km it blew the 3rd time. they covered it again, but i had an aftermarket intake on it. they said that my intake sucked in way to much sand (which i dont believe) and thats what blew the engine. my question is, why would they replace the engine if it was caused from my intake? they dont validate warranties if the engine is modified out of their shops... the dealership told me that if i left my intake on, that my warranty on that last engine was null and void. so now when it goes in for service, the intake comes off... the warranty expired at 138000 km, and im at 176000 km now... hoping it will last longer... i still have 3 years to pay off... and my engine light is on again....

So let me get this sraight, you install a ton of mods to make the car run faster or whatever. It is out of warranty by 6000 miles and you want GM to pay for it because?

GM is still posting profit losses compared to eariler years, I dont think they are going to, or have to, help you for that matter.

People are way too quick to sue nowadays. You're out of the warranty period - plain and simple.

People are way too quick to sue nowadays. You're out of the warranty period - plain and simple.



this is the fact, Im going through trying to get my $Hit rebuilt cause I got around 9k miles left on my warranty
